New advertising code in Spain

On November 14, the Joint Monitoring Commission met to discuss and agree on a new proposal for online gambling regulation in Spain. The person in charge of writing the new regulations has been JDigital (Spanish Digital Gaming Association) in collaboration with the main gaming operators. The DGOJ has already given the green light to these measures and they will take effect on January 15, 2020.

With this new agreement, the gambling companies undertake to establish additional control measures related to advertising activity, both on television, radio and online advertising, for the benefit of consumers and users and also of the sector itself.

Main measures adopted in the new advertising code

The Código de Conducta sobre Comunicaciones Comerciales de las Actividades de Juego prohibits the use of elite athletes or public figures as an image to promote the game. It is also not allowed to display images of men and women under the age of 25. With these new measures, they mainly seek to protect minors and other vulnerable groups.

As of January 15, 2020, gambling operators in Spain will not be able to offer welcome bonuses greater than 200 euros. They must also include logos of warnings about responsible gambling and the prohibition of children under 18 playing. In addition, they can only be issued between 22:00 and 06:00.

Among the measures adopted is the prohibition of inciting the addictive practice of gambling, of presenting gambling as a solution to economic problems or a way to recover money lost in gambling.
